It turned out that only a small part of the loans provided for the project by Baturina's structures went to the account of the Moroccan company Andros Bay, which was supposed to deal with the project. The rest of the money was transferred to offshore companies, including €5 million to Ridgegrove Investments Ltd registered in the British Virgin Islands (BVI), whose beneficiary was Chistyakov. The businessman himself did not provide funding, Baturina pointed out. In a lawsuit filed in the High Court of London, she asked to terminate the agreement, to return almost € 98 million to her, including damages and interest. Later, Baturina reduced the amount of claims to €74 million, refusing to pay interest. A lawsuit against BVI for € 5 million, in which Baturina accused Chistyakov of withdrawing this money to offshore companies associated with him, Chistyakov lost in 2014. Now this money is being collected from the funded Sylmord Trade Inc., which, in turn, is in the process of liquidation. She is also the owner of land in Morocco.
Earlier, according to representatives of Luzhkov's wife, Chistyakov insisted that the trial be held in Russia, but due to the fact that Elena has been living in London in recent years and is a UK taxpayer, it was decided to transfer the lawsuit to the capital of Foggy Albion. At the same time, Chistyakov ignored the fact that he himself is the chairman of the board of RusPetro, whose shares are listed on the British Stock Exchange.
Chistyakov denied all accusations. The money contributed by Baturina went to buy land and compensate for the investments already made in the project by its other participants, the businessman told Vedomosti. According to him, although the agreement with Baturina was about 35% in the joint venture, he personally owned only 8.5%, and the rest was owned by his three partners - Andrey Krupnov, who was engaged in development in Morocco, and two Moroccan businessmen. The reason for the failure of the project was the economic crisis, problems with attracting bank loans, the refusal of the Moroccan government to create infrastructure, etc., Chistyakov believes.
The judge of the High Court of London agreed that Chistyakov did not fully fulfill his obligations under the contract with Baturina, but did not conclude that these actions made it impossible to implement the project. The losses suffered by Baturina cannot be calculated on the basis of the materials presented, the judge decided. She cleared Chistyakov of fraud charges, noting that Baturina and Chistyakov are experienced players who decided to jointly engage in a highly speculative foreign real estate project, but did not receive the expected profit: "It was an inherent risk."
Baturina is satisfied with the fact that the ex-partner failed to fulfill key obligations under the contract in terms of financing the project, but is upset that the court could not determine the amount of damages to be compensated, her lawyer Michelle Duncan said. Now, according to him, other possible options for compensating for the losses she has suffered are being considered. The fact of partial non-fulfillment of obligations by Chistyakov does not automatically inflict losses on Baturina, argues the chairman of the Arbitration Court of Moscow and the Moscow Region Oleg Sukhov: the court considered that the presence of other unfavorable circumstances and the prescription of the events that took place do not allow us to establish whether Baturina suffered losses, and if there were, then in what size.

Journalists from the French Le Monde and the Swiss Le Matin Dimanche, working with the Mossack Fonseca archive, indicated that at least €13 million from the “Moroccan project” were sent by Alexander Chistyakov to the accounts of three offshore companies registered through this firm, all of which were managed by one and the same provider company based in Geneva.
